Buying an apartment in Tbilisi as a foreigner is legally simple and practically full of holes. No permit, no local partner, no residency requirement, and the registry can move title in a day. What catches people is everything the registry does not check for you: whether the building is licensed, whether the seller has a spouse with a claim, whether the advertised size is the registered size. Here is the sequence that survives a Georgian closing.

What a foreigner is allowed to buy

Georgia does not screen foreign buyers of apartments. There is no approval step, no minimum investment and no requirement to hold a permit or a company. You take the same title a Georgian citizen takes, recorded against the same cadastral code.

Only the registry transfers ownership

A signed contract does not make you an owner here. The entry does.

Ownership moves when the National Agency of Public Registry records your name against the cadastral code. Until that entry exists you hold a claim against the seller and nothing else. That is why serious closings happen at a Public Service Hall counter rather than over email.

The practical consequence is a payment rule. Never release the full price against a signature alone. Release it against the registry entry, or against a filed application with the balance held until the new extract issues.

The documents the counter actually wants

Your passport, spelled the same way twice

The registry records foreign owners against passport data. Make sure the name on the contract matches the passport character for character, middle names included. A mismatch does not get quietly corrected. It suspends the file.

Signature authentication

A power of attorney if you are not in the country

A power of attorney that says "to purchase real estate in Georgia" gives your representative far more room than you meant to give, and can still be refused as too vague. Name the cadastral code, the maximum price and an expiry date.

Read the extract before you read the contract

The extract from the public register is the only document that settles anything. Order it yourself through the agency's e-services rather than accepting a PDF from the seller's phone, and order it again on the day you pay.

Six things to check on it, in this order.

The registered owner, and whether that is the person you have been negotiating with. Mortgages and other charges, which do not vanish because the seller promises to clear them. Seizures and court restrictions. Co-owners, including a spouse with a marital claim. The status of the land plot under the building. The registered floor area against the advertised floor area, which in new builds is often measured on a different basis.

Georgian listings sell condition as a shell type. The vocabulary is local, the definitions vary by developer, and the gap between two of these words can be a third of your budget.

Buying off plan without buying air

Off-plan units are cheaper for a reason: you are paying for a promise secured by a company you cannot easily sue.

Three checks make the difference. Confirm the developer holds registered title to the land plot, which the extract for that plot shows. Confirm a construction permit exists and matches the building being marketed, checked against the municipality's own records rather than the sales brochure. Then register your contract.

That last step is the one most foreign buyers skip. The registry has a fee line for registering an obligation tied to ownership rights, at the same 150 GEL as a transfer, and it puts your claim on the public record against that cadastral code.

AN UNREGISTERED OFF-PLAN CONTRACT IS JUST PAPER

If your purchase is not recorded against the property, nothing on the public register tells the next buyer, or the developer's creditors, that you exist. Pay the 150 GEL, register the obligation, and stage the rest of your payments against construction milestones rather than calendar dates.

Paying for it

The lari is the legal tender on Georgian territory. Listings are quoted in US dollars out of habit, while the contract and the settlement are normally expressed and paid in GEL. Fix the conversion mechanism in the contract itself, naming the rate source and the date.

Pay by bank transfer through a Georgian account. It creates the paper trail you will want later for a residence permit file, for proving your cost base on a future sale, and for your home tax authority. Cash closings still happen here, and they are a poor idea for a foreign buyer with nothing else to prove.

Georgian banks do lend to non-residents, on tighter terms and with more documentation than a resident faces. Treat the mortgage as its own process with its own timeline. It does not run comfortably alongside a two-week closing.

Property ownership can support a short-term residence permit, and the threshold is no longer the number most guides still print. The current consolidated text of the Law on the Legal Status of Aliens and Stateless Persons sets the bar at immovable property, agricultural land excluded, with a market value above the GEL equivalent of USD 150,000. The earlier figure was USD 100,000.

Two details decide these applications. The value that counts is an appraisal by an assessor accredited under the national accreditation body, not the price on your purchase contract. And the permit is short-term, issued for a period and renewed, rather than granted once and forgotten.

APPRAISE BEFORE YOU COMMIT

If the permit is the point of the purchase, get an indicative valuation from an accredited assessor before you sign. An apartment bought right at the threshold can appraise below it, and the contract price will not save the application.

What ownership costs after the keys

Property tax on immovable property held by individuals is income-tested rather than automatic. It is self-declared to the Revenue Service, the rate is capped at 1% of market value, and the annual payment date falls in mid-November.
